“APC” means Air Philippines Corporation

ELIGIBILITY:  Sales and ticketing of Holiday Escapades tour packages will be done only in the Philippines.

1. IMPORTANT REMINDER: Passengers must bring all required APC valid documents (i.e. ticket and tour vouchers) on departure date to avoid any inconvenience.
   
   APC and Hotel/Tour Operator partners will refuse to render service without proper documents.



2. Services to be rendered by APC’s Hotel/Tour Operator partners shall be limited on what is specified on the Tour Voucher – Service Coupon. Any incidental expenses not indicated in the coupon shall be for the account of the passenger(s).



3. Package price are based on STANDARD ROOM of hotels unless otherwise stated.
   
   Single – applies to one person occupying a room by himself/herself.
   ½ Twin – applies to one person sharing a room with another person
   Extra Bed – applies to a third person sharing a room with two other persons. Only one Extra Bed per room will be provided.
   
   In the event, the period of stay in a hotel/resort covers two seasonality (two periods with different price rates), the higher tour package price shall apply.
   
   Package price excludes insurance surcharge/fuel surcharge/airport fees / terminal fees/government taxes and all other expenses of a personal nature e.g. tips, proterage etc.



4. Hotel accommodation and tour services may vary in different destinations. APC does not guarantee the standard, class, or fitness of the accommodation or service to be provided.



5. Reservations should be made through APC Reservations of Ticket Office or an APC authorized travel agent at least 5 working days before departure date.
   
   The person effecting a booking shall be deemed to have accepted the Terms and Conditions on behalf of all the named in the booking.



6. Special requests such as but not limited to room location, a particular view, etc. are not guaranteed and do not form part of the passenger’s booking with APC.



7. Passengers must present APC tickets/traffic documents upon check-in at the airport.



8. Upon arrival at destination:
   
   
   1. Hotel – present Tour Voucher-Service Coupon 1 upon check-in.
   
   
   2. Tour – present Tour Voucher Service Coupon 2 to designated tour guide before the star of the tour.



9. Rebooking/Cancellation/No-Show Penalties: After a ticket and tour voucher issuance, Ticket and Tour Voucher is subject to applicable penalties/forfeiture if not used on flight/date specified. The following rules shall apply:

      If notice of rebooking or cancellation is received 4 working days or more before departure date, tickets and tour vouchers must also be presented at an APC ticket Ticket Office no later than 4 working days before departure date otherwise the required notice is not deemed received.
      
      If notice is received less than 4 working days before departure date, tickets and tour vouchers must also be presented at an APC Ticket Office on the same day the notice is given otherwise the required notice is not deemed received.
   
   
   
   2. Partially Used: Forfeiture of total package, non refundable
   
   
   
   3. Rebooking of the return flight once travel has commenced is subject to PHP300.00 penalty per person
   
   
   
   4. Failure of the passenger to show up at the destination on the date specified in the Tour Voucher will result in the forfeiture of the whole Tour Package.
   
   
   
10. Changes: If we have to change your bookings or part of it (for instance if an airline changes its schedules or if the hotel overbooks its hotel accommodation or for reasons beyond APC’s control), we will notify you. If the change or changes result in your holiday costing more or otherwise being materially different from that contemplated prior to the change or changes being effected, it is hereby agreed that APC shall only be obliged to make similar or comparable arrangements or to refund the amount paid and APC shall not be liable for any other actual, incidental or consequential expenses, costs or damages of whatever nature in relation to such changes/s.



11. OPERATOR’S TERMS & CONDITIONS: Passengers must comply with the terms and conditions of the hotel, resort, tour operator, land and sea transport operator, and others engaged in carrying out the tour services (hereinafter referred to as Operator) and shall personally negotiate and be accountable for other arrangements not covered by the tour voucher.



12. DISCLAIMER AND LIABILITIES EXEMPTION: Passenger or the booking agent in behalf of the passenger, agrees and accept that APC shall not be responsible for any other claim, demands, suits, actions, or proceedings whatsoever for any and all damage, loss, injury, death, accident or liability, actual or contingent, caused to the passenger or his/her property arising out of or attributable to circumstances while in transit not on board APC’s aircraft or to the action, inaction, misconduct or negligence of the hotel, resort, tour tour operator, land and sea transport operator, helicopter, transport operator, and others engaged in carrying out the tour services, including but not limited to delays and alterations made in the program or changes in the quoted rates.


APC may cancel the journey or passage or refuse to carry or load any person or baggage whenever such action is necessary under the applicable government regulations or whenever such action is necessary by reason of weather conditions or other fortuitous events or any other reasons beyond the control of APC.

APC shall not be liable under any circumstances for any of the expenses, damages or losses incurred or sustained by any passenger, which arise from or as a result of, are in any way connected with the failure of the passenger to take the flight due to the passenger’s non-compliance with airline check-in and boarding procedures.


13. TERMS AND CONDITIONS GOVERNING AIR TRANSPORTATION: To the extent not in conflict with the foregoing, air transportation services performed by APC are subject to:
    
    
    1. Provisions contained in the ticket;
    
    
    
    2. Applicable tariffs;
    
    
    
    3. APC’s General Conditions of Carriage, policies, provision and other government related regulations, which are made part hereof.
    
    
    
14. GOVERNING LAW AND JURISDICTION: The Terms and Conditions of the Holiday Escapades Tour Package shall be governed and construed in accordance with Philippine laws. Any claim or dispute arising from these Terms and Conditions shall be properly filed in the proper courts of Pasay City, Philippines, to the exclusion of all other courts.
